These terms govern the use of Playlistation (part 1) and the purchase of a paid subscription (part 2). They are agreed between you and Thomas Bernard, Entrepreneur Individuel (a French sole trader), whose details are in the legal notice. How we handle your data is described in the privacy policy. This English text is a translation of the French version.

Part 1 · Terms of use

1. The service

Playlistation creates and keeps up to date, on your Spotify account, playlists built from your liked songs and the filters you choose. It works with a Spotify account, free or Premium, and offers a free plan (Free) and paid plans (Plus and Pro) described in the app and in the documentation.

2. Your account

  • You sign in with your Spotify account. You must be at least 15. A minor may only buy a paid plan with the consent of a parent or legal guardian.
  • You accept these terms the first time you sign in, and again for each new version that requires it. We record the version you accepted and when.
  • Spotify asks you to renew the authorisation you gave Playlistation every six months. Without it, your playlists stop updating. We email you before it runs out.
  • You can delete your account at any time from Settings, Account tab. Deleting it erases your data and ends any subscription immediately.

3. What you agree not to do

  • get around the limits of your plan, or automate calls to the service outside the app;
  • disrupt the service, try to reach another user's data, or use Playlistation against Spotify's terms of use;
  • modify the Spotify Platform, Spotify Service or Spotify Content, or create derivative works based on them;
  • decompile, reverse-engineer, disassemble or otherwise reduce the Spotify Platform, Spotify Service or Spotify Content to source code or any other human-perceivable form.

4. Spotify

Playlistation uses the Spotify Web API and is not endorsed by, affiliated with or sponsored by Spotify. We make no warranties or representations on behalf of Spotify, and we expressly disclaim all implied warranties with respect to the Spotify Platform, Spotify Service and Spotify Content. We alone are responsible for Playlistation, and we disclaim any liability on the part of Spotify or any other third party. Spotify is a third-party beneficiary of these terms and of our privacy policy, and is entitled to enforce these terms directly.

The service depends on Spotify: if Spotify changes or withdraws part of its API, we may have to change or withdraw the Playlistation feature that relies on it. We tell you as soon as we know.

5. Availability

We do our best to keep the service running at all times. Maintenance, an outage at one of our providers or a limit set by Spotify can delay your playlist updates. Playlists already created stay in your Spotify library.

6. Ownership

The Playlistation software, brand and website are ours. Your playlists and settings are yours. Tracks, artwork and metadata remain those of Spotify and the rights holders.

7. Suspension

If you break section 3, we may suspend your account after writing to you, or straight away when the security of the service or of other users is at stake. A paid subscription is then refunded for the unused part of the period, except in case of fraud.

8. Changes to these terms

We email you at least 30 days before a new version of these terms applies, with a summary of what changes. We do not change the duration, price or essential features of a running subscription on our own. A price increase only applies from the renewal after that email, and you can cancel before it. If you refuse a new version, you can cancel and delete your account before it takes effect. A correction that changes nothing for you needs no new acceptance.

9. Liability

We are liable for direct damage caused by our failure to meet these terms. We are not liable for the consequences of a change to, or an interruption of, the Spotify service, or of a use that breaks section 3. Nothing in these terms limits the rights the law gives you as a consumer.

Part 2 · Terms of sale

10. Seller and offer

The seller is Thomas Bernard, Entrepreneur Individuel (see the legal notice). The Plus and Pro plans are monthly subscriptions. A yearly subscription taken before October 2026 keeps renewing every year. What each includes is described on the Subscription page of the app and in the documentation.

11. Price and payment

  • The price of each plan is shown, taxes included, in euros or US dollars, depending on your country. A price in euros includes VAT. The total amount is shown on the payment page before you pay.
  • A change to our prices applies to new subscriptions only: an active subscription keeps its price for as long as it stays active, including a price that is no longer sold. Switching from Plus to Pro, or back, is at the chosen plan’s current price, and subscribing again after cancelling is at the current price. A discount, such as the one offered when you cancel, applies for the number of months it states, then the subscription goes back to its usual price.
  • You pay by card through our provider Stripe. We never see your card number.
  • The price is charged when you subscribe, then at the start of each period. If every payment attempt fails, the subscription ends and your account goes back to the Free plan.
  • An invoice is available for every payment on the Subscription page.

12. Ordering

You pick a plan, then confirm your order on the payment page, which sums up the plan, the period and the total amount and asks you to accept these terms. The payment button places an order with an obligation to pay. We then email you a confirmation with the same information and a link to the version of these terms you accepted.

13. Duration, renewal and cancellation

  • A monthly subscription lasts one month and a yearly one lasts one year. Each renews automatically for the same duration, at the same price (section 11).
  • For a yearly subscription, we write to you between three months and one month before it renews, with the date until which you can stop it.
  • You can cancel at any time, in a few clicks, with the cancel button on the Subscription page. Cancelling takes effect at the end of the paid period: you keep your plan until then, then move to the Free plan. We confirm the cancellation by email.
  • Except when you withdraw (section 14) or in the case set out in article L215-1 reproduced below, the current period is not refunded.

14. Right of withdrawal

You have 14 days from the day you subscribe to withdraw from the contract, without giving a reason. A renewal does not start a new period.

  • How. If your billing address is in the European Union or the European Economic Area, the "Withdraw from contract here" link on the Subscription page is available for the whole period. Wherever you live, you can also send us the form below, or any clear statement, at contact@playlistation.com. We email you an acknowledgment of receipt.
  • Immediate start. Before paying, you ask for your subscription to start straight away: the order cannot go through without that request. If you then withdraw, you pay for the days up to your withdrawal, pro rata of the period. A subscription started without that request is refunded in full.
  • What happens. The subscription ends on the day you withdraw and your account goes back to the Free plan. We refund you within 14 days, with the payment method you used.

15. Legal guarantee of conformity

The service is covered by the legal guarantee of conformity for digital content and services (articles L224-25-12 and following of the French Consumer Code). If it does not conform, write to contact@playlistation.com. You are entitled to have it brought into conformity or, failing that, to a price reduction or to end the contract.

16. Complaints and mediation

Write to us first at contact@playlistation.com. If we cannot find a solution, you can refer the matter free of charge to our consumer mediator: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, https://www.cm2c.net, within a year of your written complaint.

17. Governing law

These terms are governed by French law. If you live in another country, you keep the protection of the mandatory consumer rules of its law. In case of dispute, the competent courts are those the law designates.

18. Reproduced articles (article L215-4 of the French Consumer Code)

French law requires these articles to be reproduced in full. Their official text is the French one, in the French version of these terms. In short: for a fixed-term contract that renews automatically (our yearly plan), we must remind you in writing, between three months and one month before the deadline, that you can stop the renewal (L215-1). If we fail to, you can end the contract free of charge at any time after the renewal and get back the unused part within thirty days, with interest at the legal rate if we pay late (L241-3). These rules also protect non-professionals (L215-3).
